Muslim Divorce Guidelines: Supreme Court Seeks Centre’s Reply

Muslim Divorce Guidelines | New Delhi / Hyderabad, Oct. 16 (Maxim News) : The Supreme Court of India has sought the Centre’s response to a petition seeking uniform legal guidelines for different forms of divorce under Muslim personal law.

A bench headed by Chief Justice of India Surya Kant issued notices to the Centre and other concerned parties on October 16. The petition seeks safeguards to protect women’s rights and ensure fair procedures in marital dissolution.

The petitioner argued that certain forms of divorce, including Talaq-e-Hasan, Talaq-e-Ahsan and Khula, require clearer legal safeguards. The plea raises questions about equality, dignity and constitutional protections for Muslim women.

It also seeks uniform procedures to regulate unilateral divorce outside court and prevent arbitrary decisions affecting women and children. These are the petitioner’s arguments and have not been established as findings by the court.

The petition distinguishes these practices from Talaq-e-Biddat, commonly known as instant triple talaq. The Supreme Court invalidated instant triple talaq in 2017, and Parliament subsequently enacted legislation prohibiting the practice.

The petitioner contends that other forms of divorce continue to operate without a uniform framework of procedural safeguards. The plea asks the court to consider guidelines that would protect the rights and interests of women during divorce proceedings.

The bench has sought the Centre’s response, including its position on possible safeguards and the role of the Union Law Ministry. The notices do not amount to a final ruling on the constitutional validity of the practices mentioned in the petition.

The Supreme Court will consider the matter further after receiving responses from the concerned parties. The legal questions surrounding the different forms of divorce remain subject to judicial consideration. (Maxim News).
