Supreme Court Postponed Hearing On MLC Kavitha’s Petition

Delhi/Hyderabad, March 27 (Maxim News): A hearing was held in the Supreme Court on the petition filed by the BRS MLC K. Kavitha and the daughter of Chief Minister K. Chandrasekhar Rao against the Enforcement Directorate. However, the Supreme Court bench comprising Justice Ajay Rastogi and Justice Bela M. Trivedi has adjourned the hearing for three weeks.

Senior Advocates Kapil Sibal and Vikram Chaudhuri argued on behalf of Kavitha had made a new request in her petition. A Special Investigation Team (SIT) has been asked to be formed to probe the Delhi Liquor scam. she said in a petition in the Supreme court alleging that the ED is denying her rights as a woman.

In the petition, Kavitha sought that the notices issued to her under Section 50 of the PMLA Act to appear in person were inconsistent with Section 160 of the CrPC and that the video recording in the presence of a lawyer should be ordered while recording the statement. Kavitha said in the petition, during the investigation, there are many examples of ED officials causing mental and physical torture. Kavitha stated in the petition that the behavior of the ED officials was shocking. She said that the manner in which the ED officials behaved towards some of the accused made her anxious and afraid, Kavitha asked for proper directions to conduct the investigation under the surveillance of CCTV cameras.

Kavitha also requested the Supreme Court for canceling the confiscation notices issued for seizing her phones, she requested that orders be given that the seizure of the phones is invalid and this petition should be attached to the case of Nalini Chidambaram vs. Enforcement Directorate.

Solicitor General Tushar Mehta and Additional Solicitor General SV Raju argued on behalf of the ED brought to the attention of the court that this case is not normal, and the ED has filed a caveat petition not to issue orders without consulting them. The Supreme Court has adjourned the case for 3 weeks. (Maxim News)
