Waqf Act Protest Committee Terms Supreme Court’s Interim Judgment “Incomplete and Unsatisfactory”
Waqf Act Protest Committee | Hyderabad, Sept. 16: The Waqf Act Protest Committee for Telangana (WAPCTG), functioning under the supervision of the All India Muslim Personal Law Board (AIMPLB), has voiced deep disappointment over the Supreme Court of India’s interim judgment on the Waqf (Amendment) Act 2025.
The committee described the order as “incomplete and unsatisfactory,” saying it failed to address key constitutional concerns.
At a press conference held in Hyderabad, AIMPLB members Dr. Mateen Quadri, Dr. Mohd. Mushtaq Ali, Prof. Quddusia Sultana, and Jaleesa Sultana joined senior WAPCTG leaders including Convenors Mufti Omer Abideen, Moulana Shafeeq Alam Khan, and Moulana Gayaz Ahmed Rashadi. Also present were Joint Convenor Mohd Rafathullah Shahid, members Moulana Syed Nisar Ahmed Agha and Moulana Syed Ahmed Hussaini Sayeed Quadri, alongside Mufti Mahmood Zubair Qasmi, General Secretary of Jamiat Ulama Hind, Telangana and Andhra Pradesh.
Waqf Act Protest Committee | Partial Relief, But Major Concerns Remain
While the apex court has stayed several provisions, community leaders expressed dissatisfaction that broader issues were left untouched. “While the Court has granted partial relief, it has not addressed the wider constitutional concerns, which has left us disappointed,” said Mufti Omer Abideen.
He added that many crucial provisions, “which on the face of it end in the understanding of community at large, are completely arbitrary; have not been a stay at interim stage.” He warned that the government’s approach appeared “prejudiced,” raising fears of potential misuse of the provisions that remain active.
Key Reliefs Granted by Supreme Court
The Supreme Court stayed provisions requiring government validation of waqf ownership, stating that executive authorities cannot decide citizens’ property rights. It also blocked Section 3C, which gave government officers unilateral powers to determine who can create a waqf.
Further, the Court restricted non-Muslim representation in Waqf Boards to a maximum of four in the Central Waqf Council and three in State Waqf Boards.
It also suspended the requirement that a person prove they had practiced Islam for five years before creating a waqf.
However, the refusal to halt the Act in its entirety has left several contentious provisions in force, including the derecognition of “waqf by user” and the mandatory need for a waqf deed.
The Board termed these measures a direct threat to Islamic legal traditions and waqf property protections.
Waqf Act Protest Committee | Nationwide Campaign to Intensify
The AIMPLB reiterated its demand for a complete repeal of the Waqf (Amendment) Act 2025. AIMPLB members Dr. Mateen Quadri, announced that the “Save Waqf Campaign” will continue in full force.
The campaign’s second phase, launched on 1 September 2025, includes dharnas, demonstrations, waqf marches, leadership arrests, interfaith conclaves, and press meets.
It will culminate in a massive rally at Ramlila Maidan, Delhi, on 16 November 2025, with nationwide participation expected.
