High Court Slams Colleges for Withholding Certificates Over Fee Reimbursement Dues
Hyderabad, Jan. 30 (Maxim News) : The Telangana High Court on Thursday strongly criticised private colleges for withholding students’ original certificates citing pending fee reimbursement dues, declaring the practice illegal and unconstitutional.
Hearing petitions filed by several student organisations, the Division Bench led by Chief Justice Aparesh Kumar Singh made it clear that students cannot be harassed for delays attributable to the government. The court observed that denying certificates directly harms students’ careers and employment opportunities.
The High Court directed the Telangana government to submit a detailed explanation within two weeks on the total pending fee reimbursement dues and the timeline for clearing them.
The bench questioned the recurring delays and sought accountability from the administration.
The court categorically ruled that no educational institution has the authority to retain original certificates as collateral for unpaid fee reimbursement amounts.
It noted that such actions force students into prolonged uncertainty and litigation, which is unjust and avoidable.
The bench further remarked that colleges were violating established government guidelines by pressuring students for dues that are payable by the state.
It emphasised that financial disputes between institutions and the government cannot be transferred onto students.
The court also advised the state to create a dedicated grievance redressal mechanism.
This system, the bench said, should allow affected students to lodge complaints and obtain immediate relief without approaching courts.
The matter will be reviewed after the state files its response. The court reiterated that protecting students’ academic and professional futures remains a constitutional obligation. (Maxim News)
