Sambhal (UP)/Hyderabad, May 2: A tehsildar court in Sambhal has declared a mosque illegal and ordered its eviction after finding that it was constructed on designated graveyard land, officials said.
Court Order After Land Verification
The action followed a joint inspection by a revenue team led by Tehsildar Dhirendra Kumar Singh in Kaserua village under the Nakhasa police station limits.
- Land records showed the plot was officially classified as graveyard land
- The structure was found to be built on approximately 1,100–1,200 sq. metres
- Proceedings were initiated under Section 67 for encroachment on public land
Appeal Filed By Mosque Committee
Officials confirmed that:
- The tehsildar court has issued eviction orders
- The mosque committee has challenged the decision
- An appeal is currently pending before the District Magistrate’s court
Further action will depend on the outcome of the appeal.
Officials Cite Legal, Religious Concerns
Authorities stated that construction on graveyard land is:
- Legally impermissible under revenue laws
- Considered inappropriate even from a religious standpoint
During the proceedings, the mosque committee reportedly failed to produce documents proving ownership of the land.
Encroachments Under Scrutiny
Officials added that:
- Notices have also been issued to individuals who built houses on community land
- Encroachers have been asked to remove structures voluntarily
- Failure to comply may lead to penalties and forced removal
The case has brought attention to land-use violations and the importance of maintaining designated community spaces.
