New Delhi, July 21: The Supreme Court has observed that it is generally not appropriate for a wife to approach her husband’s employer with complaints arising out of marital disputes, noting that such actions could jeopardise the husband’s employment and adversely affect the family’s financial stability.
A Bench comprising Justice B.V. Nagarathna and Justice R. Mahadevan made the observations while hearing a transfer petition filed by a woman seeking the transfer of a defamation case from Assam to Ghaziabad, Uttar Pradesh.
During the hearing, the woman’s counsel submitted that she was already involved in multiple matrimonial proceedings in Ghaziabad and requested that the defamation case, filed in Assam by a friend of her husband, be transferred for the convenience of the parties.
Justice Nagarathna observed that courts have recently witnessed several instances where spouses approach employers over matrimonial disputes, adding that such actions may result in the husband losing his job.
The Bench noted that harming a spouse’s livelihood could also have long-term consequences, including affecting the wife’s ability to receive maintenance if the husband becomes unemployed.
According to the case records, the woman had written to the Indian Air Force authorities alleging that her husband, an Air Force officer, was engaged in private business in violation of service rules. Subsequently, a defamation case was filed against her by one of her husband’s friends.
The woman’s counsel argued that the complaint was submitted only to obtain information regarding an Air Force helmet after her husband had accused her and her brother of stealing it. The counsel also pointed out that the defamation complaint had not been filed by the husband himself.
The Supreme Court referred the matter to the Supreme Court Mediation Centre to explore the possibility of an amicable settlement between the parties. The Bench also advised that efforts should be made to resolve all pending disputes through mediation.
