Advocates Deplore Rly Claims Tribunal Working
Hyderabad, March 9 (Maxim News): The Railways Claims Tribunal Advocates Association here on Saturday alleged that the Tribunal members were violating the guidelines made by the Supreme Court of India in adjudication of the cases. They also alleged that the VC (member judicial) and member (technical) were dismissing the petitions filed by them by quoting judgments of Delhi High Court.
Addressing mediapersons at NSS news agency here on Saturday, Association vice-president P. Laxma Reddy and general secretary P. Lingeswar Rao said the acts of the members were nothing but a clear violation of Article 141 of Indian Constitution and the Supreme Court guidelines passed in the Rima Devi case. Delivering judgement, the apex court has dispensed with the exceptions like self-inflicted injuries, criminal acts and negligence of the victims and directed that the Indian Railways pay compensation to all such victims as per its Act.
The SC also overruled all the earlier judgments of the High Courts of the country providing the much needed relief to all such victims, who generally involve those who get injured while boarding and alighting from the train. However, the members of tribunal were dismissing all the cases related to such victims,” they said. The association members said they would initiate contempt of court proceedings against the two members of the Tribunal to get justice in the issue. (Maxim News)
