Assam Government Introduces Law Banning Polygamy

Dispur/Hyderabad, Nov 10 (Maxim News): The Assam government has taken a historic step by passing a new law banning polygamy in the state. The proposed legislation — “Assam Polygamy Prohibition Bill, 2025” — will be introduced in the State Assembly on November 25. Once enacted, the law will make it illegal for a man to have more than one wife at a time.

Strict Punishments and Legal Provisions

The bill proposes severe penalties for those found violating the law. Under the new provisions, polygamy will be treated as a criminal offense, and individuals marrying another person without obtaining a legal divorce or annulment of their previous marriage can face up to seven years of imprisonment.

The legislation also empowers the police to arrest offenders without a warrant, strengthening the enforcement mechanism. Additionally, the government plans to establish a special compensation fund to support women who have been victims of polygamous relationships.

Exceptions and Special Provisions

However, the new law will not apply to certain backward tribal communities and residents of Sixth Schedule areas in Assam, in deference to their customary laws and traditions.

The government has also announced amnesty for minority Muslim families whose polygamous marriages took place before 2005, clarifying that the law will not be applied retrospectively.

A Step Toward Women’s Empowerment

Chief Minister Himanta Biswa Sarma hailed the legislation as a major step toward protecting women’s rights and ensuring gender equality in the state. He said that the government’s goal is to empower women, prevent exploitation, and promote social reform.

Officials believe that the Assam Polygamy Prohibition Bill could serve as a model for other states seeking to bring similar reforms aimed at women’s welfare and social justice. (Maxim News)
