High Court Will Not Interfere In Kaleshwaram Investigation

Hyderabad, July 5 (Maxim News): The High Court of Telangana clarified that the National Dam Safety Authority, vigilance Inquiry, and former Supreme Court Judge Justice PC Ghosh are conducting a judicial inquiry into the allegation of corruption and defects in the construction of the Kaleswaram project.

A bench consisting of Chief Justice Alok Aradhe and Justice J.Anik Kumar heard the public interest lawsuits filed separately by Prajashanthi Party President K.A. Paul, Advocate B.Ram Mohan Reddy, Professor Kondandarama Reddy, Advocate Madhuganti Viswanatha Reddy and Bakka Judson on allegation of corruption in the construction of Kaleshwaram, Medigadda, etc.undertook.  

Speaking on behalf of the State government, Additional Advocate General Mohammad Imran Khan said that Justice PC Ghosh extended the Commission’s deadline as the investigation on the affairs of the Kaleswaram project was not completed.  Petitioner Ram Mohan Reddy, while giving his arguments, said that he had filed his petition on the affairs before the formation of the Commission and he had asked for an Investigation with the CBI on the corruption matters, and the CBI had also filed a counter in this petition before the single judge.

Advocate Srinivas Kapatia, appearing for the CBI, said that they are ready to implement the orders given by the court.  The Additional AG brought to the bench’s attention that the Center and the CBI have been named as respondents in this petition.

Kaleswaram project

When the bench asked how the state government could pass orders without hearing the argument, lawyer Rammohan Reddy asked to allow the government to blow the government to be made the respondent. The bench allowed this and adjourned the hearing for two weeks.

The bench refused to withdraw the petition filed by political activist Bakka Judson on Kaleswaram works.  S.Sarath Kumar, lawyer for Judson, said that they will withdraw the petition as the inquiry of Justice PC Ghosh Commission is going on. He said that the issues in the petition will be taken to the attention of the Commission and after the report of the Commission, they will approach the Court.  Responding to this, the bench stated that once a petition is filed the role of the petitioner is limited.  It clarified that no interim order can be passed allowing the complaint to be filed with the Commission.  If it is decided to withdraw, an application will be made and an order will be issued, and if there are objections to the order, the Supreme Court can be approached.  The hearing on this petition is also postponed for two weeks  (Maxim News)
