Hyderabad Police Commissioner Holds First-ever Police Adalat

Hyderabad, Dec 10 (Maxim News): C. V Anand, Commissioner of Police and Additional District Magistrate (Executive), Hyderabad Police Commissionerate today held the Court at the office of the Commissioner of Police, Hyderabad (ICCC) buildings, Road No.12, Banjara Hills, Hyderabad.

He examined the information placed before him by the SHO, Rein Bazar P.S that there is a dispute between two groups, one led by Mohd. Abdul Basith and 4 others and another group led by Mohd. Abdul Rawoof, rowdy sheeter of Rein Bazar PS over a piece of house property located in 500 Sq. Yards of land in Yakuthpura, Hyderabad. The property belongs to late Smt. Sandhya, who died in 1996, left behind her husband.

C V Anand heard the presentation of case facts by the S.H.O., Rein Bazaar PS and also heard the versions of rival parties.

Thereafter, the Commissioner ordered each to execute a bond for an amount of Rs. 25,000/- with two sureties and adjourned the matter to Dec 23.

Hyderabad Police Adalat

With the powers conferred under Cr.P.C, C.V. Anand, the Commissioner of Police, Hyderabad as Additional Executive Magistrate has implemented the 107 Cr.P.C proceedings for the first time in Hyderabad Police Commissionerate to maintain peace and good behaviour.

The quarreling groups from Rein Bazar PS limits were issued show cause notice and summoned by the Commissioner.

The hearing took place on Dec 9, in the court hall of the Additional District Magistrate specifically set up for the purpose.

The CP heard the presentation of case facts by the SHO, Rein Bazar PS and also the versions of rival parties and on satisfaction ordered each to execute a bond for an amount of Rs. 25,000/- with two sureties and adjourned the matter to Dec 23.

Anand stated that 107 Cr.P.C proceedings is a very useful tool to control the rival groups who disturb public peace and the power of executive magistrate of a Police Commissioner can be used in an effective manner to ensure peace in the area.

Illegal and unlawful activities of rowdies

Anand said these powers would be used to curb illegal and unlawful activities of rowdies, gangs, and warring gangs in future also and more such gangs indulging in group rivalry and assaults, groups fighting over religious places, over lands and properties, etc will be bound over in future.

It is known that section 107 Cr.P.C is an effective means for preventing breach of peace or disturbance of public tranquility in connection with religious processions, festivals, fairs, elections, political movements or other disputes between groups/factions that may probably occasion a breach of peace or disturbance of public tranquility that may require such person to show cause why he should not be ordered to execute a bond, with or without sureties, for keeping peace and good behaviour for a period not exceeding one year. It is not essential in every case that there should be two parties against each other.

Before starting the proceedings, the police will collect evidence of persons acquainted with the circumstances of the case, the specific occasion on which the breach of the peace is anticipated or the existence of circumstances which are likely to lead to the breach.

If any person or group commits an act that results in disturbing the peace and public tranquility in the area, he/they can be bound over u/s 107 Cr.P.C. by directing them to execute bonds to keep the peace in the area.  (Maxim News)
