Kavitha Filed A Petition in Supreme Court Again
Kavitha | Delhi/Hyderabad, April 27 (Maxim News): BRS party MLC K. Kavitha has filed the petition in the Supreme Court again, challenging the issue of whether the women can be called to the ED office for investigation.
On behalf of the Kavitha, Senior Advocate Kapil Sibal appeared before the bench of Justice Rastogi stating that the petition filed by MLC Kavitha against the ED should be heard quickly. Kapil Sibal appealed to the bench to hear Kavitha’s petition next Monday. A bench of Justice Rastogi said it would consider the request.
It may be recalled that a hearing was held in the Supreme Court last month on the petition filed by MLC Kavitha against the ED. The hearing on the petition filed by Kavitha was adjourned for three weeks. the Supreme Court has tagged Nalini Chidambaram’s earlier petition regarding calling the women to the ED office for investigation. Kavitha made a new request in her petition. A special Investigation Team (SIT) has been asked to be formed to probe the Delhi Liquor Police case. Senior Advocates Kapil Sibal and Vikram Chaudhuri argued for Kavitha.
Solicitor General Tushar Mehta and Additional Solicitor General SV Raju argued on behalf of the ED. Kavita filed a petition in the Supreme Court alleging that the ED is denying her rights as a woman. In the petition, Kavitha sought that the notices issued to her under Section 50 of the PMLA Act to appear in person were inconsistent with Section 160 of the CrPC and that the video recording in the presence of a lawyer should be ordered while recording the statement along with canceling the confiscation notices issued for seizing her phone. She requested that orders be given that the seizure of the phone is invalid and this petition should be attached to the case of Nalini Chidambaram vs. Enforcement Directorate.
The bench of Justice Ajay Rastogi and Justice Bela M. Trivedi received this petition for hearing. In the petition, Kavitha requested that the woman who was called as a witness be questioned at her home or through video conference. Kavitha stated that she was called to the ED office and questioned for violating Section 160 of Cr. PC. During the investigation, Kavitha said that there are many examples of ED officials causing mental and physical problems. Kavitha stated in the petition that the behavior of the ED officials was shocking. She said that the manner in which the ED officials behaved towards some of the accused made her afraid. In the presence of the lawyers, she asked for proper directions to conduct the investigation under the surveillance of CCTV cameras. (Maxim News)
