Kavitha Has To Co-Operate With CBI Investigation: Rachana Reddy

Kavitha | Hyderabad, Dec 5 (Maxim News): Senior High Court Advocate Rachana Reddy who is representing the BJP cases in the courts including in the High Court of Telangana has given her opinion that even though the name of the MLC Kavitha is not in the CBI FIR, she has to co-operate with the investigation agencies.

She expressed surprise that she did not understand on whose advice Kavitha wrote the letter to the CBI, she said that CBI has issued notices to Kavitha under 160 Cr.PC and it is not necessary to have the name in the FIR to issue notices under that section. She said that those who have information related to the crime can be questioned under Section 160. She clarified that the CBI has called MLC Kavitha as a witness for the investigation, but it has not been mentioned anywhere that her name is in the FIR.

Rachna Reddy said that when a notice is issued under CrPC 160, she must present. After the investigation, the CBI will take a decision whether to include her name in the list of accused or not. If Kavitha’s name is mentioned in the FIR, instead of 160 Cr.PC, 41A Cr.PC is said to give notices.

She clarified that 41A notices will be issued only to the accused and suspects. Rachna Reddy made it clear that if those who have received notices fail to attend the hearing once, they will be given another chance, and if they do not appear even then, the CBI will take the next decision.
