MLAs Poaching case: HC Adjourns Hearing to Jan 10
Hyderabad, Jan 9 (Maxim News): The High Court of Telangana adjourned the hearing of the Moinabad Farmhouse MLAs Poaching case to January 10. Chief Justice Ujjal Bhuyan conducted the hearing through virtual mode and said that he would hear the case again at 3 pm on Tuesday.
The Supreme Court Advocate Dushyant Dave on behalf of the government argued and Supreme Court Advocate Uday Holla and Sanjay on behalf of the respondents heard arguments.
Advocate Dushyant Dave, appearing for the government, requested the court that the Farmhouse case should be investigated impartially under Section 17398). The case details were disclosed in Chief Minister K. Chandrasekhar Rao’s press meeting. Dave reminded me that the Chief Minister’s press meeting was held on November 3, but the CDs were submitted to the magistrate on October 29. He said it was not right to cancel the SIT investigation on the grounds that the Chief Minister had put out the CDs. He questioned why the respondents are focusing only on the CDs leaving aside the FIR and MLA trap issues. On this, he cited the judgment of Babu Bhai’s case. He said that in the copy of the single judge’s order if a similar dispute arises in Babu Bhai’s case, the investigation agency has been changed, but the case has been given to the CID.
Advocate Sanjay who argued on behalf of the accused brought to the notice of the bench the presence of three IPS officers in the SIT. he mentioned that their promotions and transfers are in the hands of the Chief Minister. KCR made it clear that evidence was revealed in the press meeting held on December 3. He questioned how the evidence that should be with the SIT will go to the hands of the Chief Minister. Advocate Sanjay brought to the attention of the Chief Justice the fact that Dave had already apologized.
Earlier, Supreme Court Senior Counsel Uday Hulla argued on behalf of Srinivas, saying that when his client was not at home, 30 policemen came and pasted the notice. The judge brought to the attention of the police that if he did not listen, he threatened to make him an accused. However, the bench made it clear that two senior lawyers had already heard all these arguments on behalf of the defendants. (Maxim News)
