In 2016, CAt ruled that Somesh Kumar should continue in Telangana. challenging this judgment, the Central department of Personnel Affairs and Training (DoPT) filed a writ petition in the High Court in 2017. A division bench comprising of Chief Justice Ujjal Bhuyan and Justice Surepalli Nanda heard the petition at length.
Additional solicitor General T. Survakaran Reddy presented arguments on behalf of the petitioner, the Central government. The solicitor General said that the CAT acted against the IAS cadre rules and the assignment of Somesh Kumar to Telangana against the guidelines of the Pratyush Sinha Committee appointed by the Central government as per law was invalid.
Meanwhile, the Central government responded quickly after the High Court verdict. The Central Department of Training and Personnel Affairs issued an order on Tuesday directing Somesh Kumar to be relieved from duty immediately.
