BRIEF FACTS:

The A-1 Chinthala Venkateshwarlu is a native of Kothapet village, Koilkunta mandal of Kurnool District. He came to Hyderabad about ten years ago and eking out his livelihood by means of cable operator. A-2 Pathlavath Krishna Naik & A-3 Putta Venkata Ramana who are in seeds business in Nandyala town are well known to the A-1 Chinthala Venkateshwarlu having close acquaintance as they belong to Nandyala and its surrounding areas. Due to such intimacy, the A-1 to A-3 planned to earn easy money by selling the spurious seed to the gullible farmers in surrounding area of Hyderabad City by mixing the spurious seed with seed chemical and packing the same in certain labeled covers of various brands including BILLA & PAVANI exist in the open market. As per their plan, the A-1 Chinthala Venkateshwarlu has to look-after the entire maintenance of their illegal activity, while the A-2 & A-3 have to supply needful seed and other equipment required for the mixing and packing the spurious seed.

Accordingly, the A-1 took a godown for lease on the outskirts of Brahmanapally village with the help of A-4 Nomula Venkanna of Brahmanapally village who is also in same business and one marketing agent A-5 Vagalagaani Ashok belongs to Ramanujan Colony, Munaganuru village of Hayathnagar mandal. In fact, the accused persons are having no license under Seed Act 1966 to manufacture or sell the cotton seed. However, the A-1 procured the loose cotton seed i.e. (35) bags from the A-2 Krishna Naik & (17) bags from A-3 Putta Venkata Ramana along with labeled covers of various brands and its related equipment including seed mixing chemical, seed mixing machine, packing machines, weighing machine and sewing machine for packing the seed from Nandyala Town of Kurnool district and stored the same in the godown located on the outskirts of Brahmanapally village.

Thus, all the accused persons together started mixing the spurious seed with red colour seed mixing chemical and packed the same in labeled covers of other brands including SARPANCH GOLD so as to sell the seed to the gullible farmers by inducing them that they are selling the branded seed at the lower price than the Government approved seed. Recently i.e. about three days ago, the accused persons already sold the spurious seed packets to some of the innocent farmers in the surrounding area of Shadnagar town. Actual price of the branded and Government approved seed packet weighing (450) grams is Rs.730/-. But, the accused persons sell the spurious seed packet of same quantity @ Rs.500/- and thereby cheated the gullible farmers.

Today i.e. on 09.06.2020 at morning hours, while the accused persons A-1 Chinthala Venkateshwarlu, A-3 Putta Venkata Ramana, A-4 Nomula Venkanna and A-5 Vagalagaani Ashok were mixing and packing the spurious cotton seed in their godown , the Police and officials of the agricultural department have raided and caught them in possession of spurious cotton seed along with its mixing & processing equipment as mentioned above. The spurious seed weighing about (2.8) tons along with (500) numbers of labeled covers of BILLA & PAVANI brands and its related equipment being used for mixing and packing the seed were seized from the possession of accused under a cover of panchanama in the presence of mediators.
