Supreme Court Notice On Plea For Provisional SIR

Hyderabad: The Supreme Court issued notices to the Centre, the Election Commission of India and the West Bengal government on a plea that seeks provisional Special Interim Revision for Hindus, Buddhists and Christians who migrated from Bangladesh before 2014. The bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi took note of the petition filed by NGO Atmadeep. The court asked all authorities to respond. The matter will come up again on December 9.

The plea states that many migrants fled Bangladesh due to religious persecution. It says they applied for Indian citizenship before 2014 but did not receive any relief or progress. According to the Citizenship Amendment Act, these groups are eligible for citizenship. The Act covers Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan who entered India on or before December 31, 2014. The law applies to those who were exempted under the Passport Entry into India Act or the Foreigners Act.

The petition explains that the 2019 amendment added a section that allows these groups to apply for registration or naturalisation. It notes that many applications are still pending due to administrative delays. The NGO says several others are waiting to apply under Section 6B through the online process introduced by the Citizenship Amendment Rules 2024. It argues that the lack of progress leaves eligible migrants without clarity on their status.

The plea also points out that many migrants have lived in India for years. It says their names already appear on the 2025 electoral rolls. However, it argues that these individuals risk disenfranchisement during the ongoing Special Intensive Revision. It therefore urges the Supreme Court to grant them provisional voter enrolment. The NGO requests directions that protect the applicants until the citizenship process is completed.
