A bench led by Chief Justice Surya Kant and Justice Joymalya Bagchi issued notices after hearing the petitioner’s submissions.

The petitioner, represented by lawyer Haripriya Patel, also urged implementation of the National Education Policy across all regions.

The bench said it would examine the issues raised in the plea. Therefore, notices were issued to all respondents.

Right To Education Implementation Under Scrutiny

The plea raised concerns about enforceability of pre primary education for children across the country. It argued that early education remains inconsistent across states.

It also highlighted gaps in implementing the National Education Policy 2020, which has undergone updates over time.

The policy aims to transform education through flexibility, skill development, and holistic learning. It replaces the 10+2 system with a 5+3+3+4 structure covering ages 3 to 18.

Moreover, it introduces vocational training from Grade 6 and promotes AI, coding, and multilingual learning.

The PIL further sought full implementation of the Right of Children to Free and Compulsory Education Act 2009.

The law mandates free and compulsory education for children aged 6 to 14 years. It also requires private schools to reserve 25 percent seats for economically weaker sections.

In addition, the plea named the Centre, all states, and union territories as parties. Hence, the court directed all respondents to file their replies.
