The Issue Of Same-Sex Marriage Is A Complex One: Asad Owaisi 

Hyderabad, Oct 17 (Maxim News): The recent Supreme Court ruling on same-sex marriage has sparked a debate on the role of the legislature and the courts in interpreting the law.

The Court has rightly affirmed the principle of parliamentary supremacy, emphasizing that the decision on who can marry under what law is a matter for the legislature to determine.

“I have deep respect for all religious beliefs and values, and I recognize that the issue of same-sex marriage is a complex one. As a Muslim, I believe that marriage is a sacred union between a man and a woman. However, I also believe that the state should not interfere with the fundamental rights of any individual, regardless of their sexual orientation”, asad owaisi said.

“I am concerned about the observation made from the bench regarding transgender individuals being allowed to marry under the Special Marriage Act and Personal Laws. From an Islamic perspective, this interpretation does not align with our understanding, as Islam traditionally recognizes marriage as a union between a biological man and a biological woman”, he further said.

“I agree with Justice Bhat that a gender-neutral interpretation of the Special Marriage Act may have unintended consequences, particularly in terms of exposing women to vulnerabilities. It is essential to ensure that any legal changes consider and respect the diverse and deeply held religious beliefs in our society while seeking a balanced and equitable approach.

I believe that the best way forward is for the legislature to hold a comprehensive debate on the issue of same-sex marriage and enact a law that reflects the will of the people. This law should protect the rights of all individuals, regardless of their sexual orientation, while also respecting the religious beliefs of all communities”, asad owaisi tweet further added.
