There Is No Violation Of Rules In Kavitha Arrest
Delhi/Hyderabad, March 21 (Maxim News): Rouse Avenue Special Court Judge MK Nagpal had dismissed the petition of the BRS MLC K Kavitha’s arguments that the enforcement directorate (ED) did not follow the provisions under Section – 19 of the PMLA Act in arresting her in the Delhi Liquor Case.
It has been clarified that in the matter of her arrest, the ED has followed the rules. ED arrested her in Hyderabad on March 15. Appeared in court on March 16. filed a petition seeking custody. A copy of the judge’s judgment on that petition has come out. It is alleged that the accused was a partner of the South Group which paid Rs. 100 crore bribes to pubic representatives and government employees in Delhi and was involved in a criminal conspiracy from the very beginning to change the Delhi Excise system in their favor.
The statement given by P.Sarathchandra Reddy, Magunta Raghu, Dinesh Aroda, other co-accused Sameer Mahndra, Gorantla Buchibabu, Sakshi Magunta Srinivasulu Reddy, V. Srinivasa Rao and Gopi Kumaran, who were co-accused in this case and later became approvers, reflect the character of the accused. After the meeting with Kavitha, Magunta Srinivasulu Reddy and his son Magunta Raghav have given Rs. 25 crores in two installments to her follower Gorantla Buchibabu. The accused promised to pay half of this amount. An investigation is yet to be done in this regard.
Arun Ramachandran Pillai, who was made a partner in the wholesale firm Indospirit to recover the donations given is the representative/benamee of the accused. She is accused of formatting and tampering with some mobile phones. Records show that she was involved in the crime of money laundering and played a key role. A perusal of the case file submitted by the investigation officer shows that the investigation has stalled due to her non-appearance. it seems that she needs to be interrogated to unearth the major part of the proceeds of the crime.
NO VIOLATION OF THE PROVISIONS OF THE PMLA ACT
The ED officials not only arrested the accused who followed all the safeguards provided under Section 19 of the PMLA Act but also gave her the reasons for the rest in writing. There is no violation of the law. After her arrest on March 15 at 5.20 pm, she was produced before the court within 24 hours per the provisions mentioned under Section – 19(3) of the Act. She was arrested before sunset. The accused says that there is no transit remand under Sections 80 and 81 of CrPC. According to the provision of Section 19, there is no such requirement, said Special Judge MK Nagpal in his order. (Maxim News)
