Waqf Board Chairman Urged to Step Down in Line with HC Orders, New Act
Waqf Board | Hyderabad, Sept. 10 (Maxim News): Telangana Waqf Board Chairman Syed Azmathullah Hussaini has clarified that the removal of CEO Mohd Asadullah was carried out strictly in compliance with a High Court order issued under the provisions of the new Waqf Act. (which means implementation of the New Act).
In an interview to an English daily, he emphasized that the Revanth Sarkar had no choice but to implement the directive. “The Govt did not act voluntarily. It only implemented the high court order. Other provisions, such as reconstitution of the board, are still pending before the Supreme Court. There is no bar on appointing a CEO as per the act,” Hussaini told
Mohd Asadullah, a seasoned officer from the Revenue Department with more than 35 years of service, held various positions including Tehsildar before rising to the rank of Additional Collector.
He was posted as CEO of the Waqf Board when grievances began accumulating, and the board’s scheduled meetings were repeatedly deferred. After the new act came into existence, Asadullah sought clarification from the government on whether the meeting could proceed in view of the new law.
With no resolution in sight, an individual approached the court seeking removal of the CEO as per the New Act. This prompted Justice Nagesh Bheemapaka to issue an order that eventually resulted in Asadullah’s removal. The government, according to Hussaini, complied with the ruling in full.
However, ILyas Shamsi, Social Scientist argues that the state government should have taken a stronger stand by appealing against the High Court order in the writ petition filed by Md. Khutubuddin.
They question why the administration refrained from challenging the ruling if it believed in the continuity of the CEO’s role.

Activists further point out that several unanswered questions remain. They ask why sections of the community are standing firmly behind Asadullah, what he achieved during his tenure, and who Md. Khutubuddin actually is. Allegations have also surfaced about possible involvement of land mafia interests behind the legal challenge. Ilyas Shamsi insists that the chairman must address these issues openly to restore confidence among the community.
Adding to the controversy, he noted that after the High Court order was implemented under the new Act, not only the CEO’s position but even the nominated members of the board stand null and void. In that capacity, the chairman himself and other nominated members automatically stand dissolved.
This has led to fresh questions on why Syed Azmathullah Hussaini has not voluntarily resigned in the purview of the new Act, given that the same principle applied in Asadullah’s case.
The controversy is now at a critical stage. The final verdict in the appeal against the single-judge bench order is expected by the weekend. With the clock ticking, the community is waiting anxiously for clarity on the Wakf Board’s leadership and the broader implications for the management of Waqf properties in Telangana. (Maxim News)
