The petition, filed by Muslim rights protection activist and scholar S. M. Abdul Qadeer, challenged the nomination of the current Chairman Syed Azmathullah Hussaini to the Telangana State Waqf Board.
The petitioner contended that the selection was made under a category that did not exist in the governing law.
During the hearing, Justice Bheemapaka expressed concern over procedural lapses by the Waqf Board’s legal counsel.
The Judge asked why the Board’s standing counsel had failed to file both a vakalat and a counter affidavit in the matter.
Observing that this showed disregard for statutory compliance, he stressed the importance of procedural discipline in such cases.
