Mumbai: A 45-year-old woman has been booked for posting her former live-in girlfriend’s nude picture on social media. The woman sought an anticipatory bail to prevent her arrest, but the court rejected her plea on Monday. The complaint has been filed by the woman, who is also aged 45, whose nude picture was uploaded by the accused.
They both were in a relationship for a few years and they have been working in the pathology department of a reputed private hospital in the western suburbs.
This was the first such case involving a cyber crime by a woman against another in Mumbai, police said.
The FIR was registered with Navghar police station, Mulund (E) on February 4 this year. A case under the Indian Penal Code sections 354 (outraging the modesty of a woman), 506 (criminal intimidation) 509 (word, gesture or act intended to insult the modesty of a woman) and under the Information Technology Act was filed against the accused.
The two women became close friends as they had worked together for a long time. One of them was married to a man, but she divorced later. Then the couple started living together for a few months at a time in Mulund.
“Six months ago they started having trouble in their relationship,” said a police officer from the Navghar police station in Mumbai.
During this time, the complainant came to know that the accused was also using her pictures and passing them off as her own on Facebook for over two years.
The victim told the cops that on November 21 last year, she noticed that the accused had put up her nude picture as her Whatsapp display status.
The victim said when she confronted the accused about it, she was told that the pictures were taken when she was in the bathroom the previous day. The victim further said that they got into a fight after which the accused threatened to malign her by circulating the pictures and left the house.
And she did what she said. Despite the victim’s pleas to stop it, the accused refused to relent and went on circulating the nude pictures on various social networks.
The victim finally filed a police complaint on February 4.
However, the accused in her bail petition pleaded that she was innocent. Police have opposed the anticipatory bail plea on the grounds that the mobile phone was yet to be recovered and since the two worked in the same place, there were chances that the accused could influence witnesses.
After her anticipatory bail was rejected, the police arrested the accused on Tuesday.
