Refund Of Put On Hold Amount To The Victims In Cybercrime Cases

There is a huge increase in reporting of Cyber crime cases in the recent past, as such on the instructions of the Commissioner of Police, Cyberabad Commissionerate Stephen Raveendra, IPS., the Cyber Crime PS, Cyberabad took up drive to help the victims for refund of their lost money which was seized in the suspect/beneficiary bank accounts, duly following the process of court.

As a result of the drive, in (44) cases victims received court orders for refund of an amount of Rs. 2,23,89,575/- which was seized in suspect/beneficiary bank accounts.

PROCEDURE:

When a victim reports a cybercrime case incident online either through 1930 or through NCRP portal, the petition will be directed to police and the nodal officers of concerned banks, for investigation of the case.

During the investigation, concerned Investigation Officer with the help of NCRP report of bank transactions seizes the amount in the suspect accounts as per Sec 102 Cr.P.C.

Further, the I.O. intimates the same to victim/complainant to file a petition u/s 457 Cr.P.C in the Jurisdictional court which helps the victim to get the order from the honourable court to refund the amount which is seized.

After examining the petition filed by the victim and based on the findings during investigation by the Investigating Officer, the hon’ble court will pass the order
accordingly.

After receiving the court order, the I.O. will follow up with the banks and see that the amount is refunded to the victims accounts.

The drive will be continuous and with the cooperation of the Judiciary, we will be able to structure this mechanism and ensure speedy return of money to victims who lost their money to Cyber crimes.
