H-1B Visa: Just As $100,000 Shock Settles, More Changes Ahead

Hyderabad, Oct 10 (Maxim News) : The $100,000 fee introduced by U.S. President Donald Trump for newly issued H-1B visas has already rattled India’s IT sector. Now, before that shock has even faded, the Trump administration is proposing even more changes to the H-1B program.

These proposed updates, listed in the Federal Register under the title “Reforming the H-1B Nonimmigrant Visa Classification Program,” come from the Department of Homeland Security (DHS). The DHS wants to tighten eligibility for visa exemptions and increase oversight of employers—especially those involving third-party placements that often stretch visa rules. According to the proposal, the goal is to “strengthen the integrity of the H-1B visa program” and “protect the wages and working conditions of U.S. workers.”

However, much remains unclear about when and how these new rules will actually take effect. International media reports suggest that the reforms could eliminate several exemptions that currently benefit non-profit research institutions, universities, and healthcare organizations. Analysts warn that this could hurt thousands of Indian students chasing the American dream, as well as young professionals hoping to build careers in the U.S. The proposed rollout date for these rules is reportedly December 2025.

Meanwhile, the new $100,000 visa fee—implemented through an executive order last month—will remain in effect for one year. If Congress decides to pass supporting legislation, it could become a permanent policy.

For perspective, the average annual salary of an H-1B professional from India ranges between $60,000 and $140,000. That makes the additional $100,000 visa fee a heavy burden for most companies, potentially discouraging many from sponsoring new workers.

Interestingly, credit rating agency Crisil believes the increase won’t significantly harm India’s major IT firms. Still, the steady stream of H-1B revisions keeps the industry uneasy. Among other things, the Department of Homeland Security is reportedly exploring changes to the current visa lottery system—favoring only the most highly skilled foreign applicants while giving stronger preference to American workers.
