A Bench of Justices JK Maheshwari and Atul S Chandurkar overturned the decision of the Gauhati High Court.
The High Court had earlier rejected Khera’s plea for pre arrest protection.
The apex court observed that individual liberty under Article 21 must be protected.
It stressed that courts must balance fair investigation with personal freedom.
The Bench noted that the case appeared to involve political rivalry.
It said custodial interrogation was not necessary at this stage.
The court directed that Khera be granted anticipatory bail in case of arrest.
It asked him to cooperate with the investigation and appear when required.
He has also been directed not to influence witnesses or tamper with evidence.
The court further said he cannot leave India without prior permission.
The Bench found errors in the High Court’s reasoning and interpretation of the law.
It noted that certain provisions cited were not part of the FIR.
The ruling reinforces safeguards around personal liberty in criminal proceedings.
