Hyderabad, Sept. 20: Khairatabad MLA Danam Nagender has reportedly approached the Supreme Court against the Telangana High Court order disqualifying him from the Assembly.
Nagender reportedly filed a Special Leave Petition (SLP) on Saturday, seeking a stay on the High Court verdict.
He also sought a stay on the order declaring the Khairatabad Assembly constituency vacant.
Nagender has sought time to pursue his appeal before the Supreme Court, according to reports. The appeal was filed on Saturday afternoon, though it had not been numbered by the evening.
The move came a day after the Telangana High Court disqualified Nagender under the anti defection law.
Danam Nagender Faces Caveat In Supreme Court
The High Court had set aside Telangana Assembly Speaker Gaddam Prasad Kumar’s decision rejecting the disqualification petitions.
It held that Nagender’s Assembly membership stood cancelled from April 23, 2024. That was the date he filed his nomination as a Congress candidate from Secunderabad in the Lok Sabha election while serving as a BRS MLA.
The court also declared the Khairatabad Assembly seat vacant and directed that copies of its order be sent to the Election Commission of India and the Speaker’s office.
BRS MLA Padi Kaushik Reddy and BJP floor leader Aleti Maheshwar Reddy had challenged the Speaker’s decision in the High Court.
Maheshwar Reddy has now filed a caveat in the Supreme Court in the matter, according to reports.
The Supreme Court had earlier directed the Telangana Speaker to decide pending disqualification petitions involving MLAs accused of defection.
Interestingly, Nagender had welcomed the High Court verdict on Friday and said he had not considered approaching the Supreme Court.
He had also said he was prepared to contest again if an election was announced.
The latest Supreme Court appeal could now determine whether the High Court’s disqualification order and the vacancy of the Khairatabad seat remain in effect pending further proceedings.
