BJP leader Shahnawaz Hussain moves Supreme Court challenging Delhi HC order for FIR in rape case

Soon after the Delhi High Court ordered the police to file an FIR against Shahnawaz Hussain in a 2018 rape case, the BJP leader moved Supreme Court, challenging the high court’s order.

The matter has been listed for urgent hearing.

A senior lawyer said if an FIR is registered, the petition will become infructuous, adding that he had a 30-year-long career in politics and this would destroy his reputation.

The Chief Justice of India (CJI) has said the Supreme Court will hear the matter next week.

Earlier, the Delhi High Court dismissed his plea and ordered the police to file an FIR against BJP leader Shahnawaz Hussain in a 2018 rape case and gave a period of three months to complete the investigation.

The Delhi High Court said after looking at the facts it was evident that the police were reluctant to file an FIR in the case.

The court also said the lower court had rejected the police argument and observed that the woman’s complaint made a case for a cognizable offence.

In January 2018, a Delhi-based woman filed a petition in the lower court to file an FIR against Hussain. She alleged that the BJP leader had raped her and threatened to kill her.
