No One Has Right To Disrespect Army And Individual In Name Of Freedom Of Speech: Allahabad High Court

Lucknow/Hyderabad, June 5 (Maxim News): The Allahabad High Court has ruled that freedom of expression is also subject to certain reasonable restrictions. It has made it clear that the freedom to speak as one wishes while denigrating the Indian Army or other people cannot be considered freedom of expression. The court has criticized the behavior of Congress leader Rahul Gandhi.

Uday Shankar Srivastava, retired director of the Border Roads Organization, has filed a complaint in a Lucknow court alleging that Rahul Gandhi spoke in a way that denigrated the Indian Army during the Bharat Jopdo Yatra in 2022.

The court issued summons to Rahul Gandhi. It ordered him to appear before it for questioning. Rahul approached the Allahabad High Court seeking to quash this summons. The High Court took up his petition on Wednesday. It recalled that Article 19(1)(a) of the Constitution grants citizens the right to freedom of speech.

However, it said that no one has the right to speak in a way that denigrates the army or individuals. The High Court dismissed Rahul Gandhi’s petition. It ruled that he will have to face the trial in the lower court. (Maxim News)
