Supreme Court hears transgender rights bill challenge

Supreme Court | New Delhi, May 4: Supreme Court hears transgender rights bill challenge and issues notices to the Centre, states, and Union Territories on petitions against the amendment.

The petitions challenge the Transgender Persons Rights Protection Amendment Bill 2026. They argue that it violates the right of self determination.

The Supreme Court of India sought responses from the Union government and all states. As a result, authorities must submit their replies in the next hearing.

The bill requires transgender persons to undergo medical treatment to obtain official gender identity certification. However, petitioners argue that this condition violates fundamental rights.

They said the rule undermines personal autonomy. Moreover, they argued that self identification should not depend on medical procedures.

A bench led by Chief Justice Justice Surya Kant is hearing the matter. In addition, the court has formed a three judge bench for detailed examination.

The court said it will review the legal and constitutional aspects. Meanwhile, it has not passed any interim order yet.
