Hyderabad: The Telangana High Court has directed Guru Nanak Homoeopathic Medical College and Hospital in Ibrahimpatnam to refund the tuition fee paid by a student whose BHMS admission was later cancelled over her NEET score.
Justice Juvvadi Sridevi passed the order on September 22 while disposing of a petition filed by Done Shabari Priya from Adilabad district.
The student was initially allotted a management quota seat by Kaloji Narayana Rao University of Health Sciences (KNRUHS). She paid the full tuition fee of about ₹3.32 lakh and was permitted to join and attend the course.
However, KNRUHS cancelled her admission on January 23, 2026. The university stated that she had scored 128 marks in NEET, against the required 144 marks.
Shabari Priya then approached the High Court seeking restoration of her admission. Alternatively, she sought a refund of the fee along with compensation.
Court Says College Cannot Retain Fee
Her counsel, Baglekar Akash Kumar, argued that the student should not suffer financial loss after acting on the university’s allotment and paying the fee. He pointed out that the university, college and state government did not dispute that she had initially been allotted the seat and permitted to join.
The High Court observed that once the university allotted the seat, permitted the student to join and accepted the fee, the institution could not retain the money after subsequently cancelling the admission.
The court made it clear that it was not expressing any opinion on the validity of the admission cancellation itself.
Justice Sridevi directed the college to return the entire tuition fee within six weeks.
The ruling therefore addresses the student’s financial loss following the cancellation. It does not decide whether the original admission cancellation based on her NEET score was legally valid.
