Hyderabad: Telangana High Court on Thursday issued an interim order protecting the Dargah Hazrath Syed Tajuddin Khaja Bagh Sawar from being relocated. Justice B. Vijaysen Reddy passed the order after the matter was moved through a lunch motion. The dargah is located within the premises of the Sri Raja Rajeshwara Swamy Temple at Vemulawada in Rajanna Sircilla district.
The Court heard a writ petition filed by Mohammad Nazima. The petition challenged the alleged illegal fencing, barricading and obstruction of access to the dargah by the authorities. Counsel for the petitioner, Zeeshan Adnan Mahmood, submitted that the shrine is believed to be over 800 years old and dates back to the 12th century. He said the dargah has historically stood alongside the renowned Vemulawada temple as a symbol of communal harmony and shared cultural heritage.
The petitioner contended that attempts by officials, including the District Collector and the Devasthanam authorities, to relocate the shrine would seriously affect the region’s composite cultural fabric. Meanwhile, the counsel argued that the Mutawalli of the dargah has no legal authority to consent to any relocation. He further stated that such power vests exclusively with the Telangana State Wakf Board under the applicable law.
Taking note of these submissions, the Telangana High Court recorded the undertakings given by the District Collector, the Executive Officer of the temple and the Superintendent of Police of Rajanna Sircilla district. Based on these undertakings, the Court directed that no coercive steps of any nature, including relocation, demolition or alteration of the dargah, shall be undertaken.
The matter has been posted for further hearing. Therefore, the interim protection granted by the Telangana High Court will remain in force until the next hearing. The case centres on the protection of the centuries old dargah located within the temple premises at Vemulawada.
