Wakf: Time is ripe for implementation of KCR Promises

Wakf | Hyderabad, Dec 20: While appreciating the out standing services for overall development of our Telangana State by young and energetic leader of BRS Kalvakuntla Taraka Rama Rao, Abul Fateh Syed Bandagi Badesha Quadri Social Scientist and Sufi priest Balkonda Shareef Dargah Hazrath Syed Shah Bandagi Badshah Quadri (R.H.) Nizamabad District T.S said now it’s high time government should implement Chief Minister policies for the development of waqf institutions.

Syed Abul Fateh Bandagi Badesha Quadri urged the Minister for Municipal Administration and Urban Development, K. Tarak Rama Rao to kindly instruct the Greater Hyderabad Municipal Corporation (GHMC) authorities not to damage the grave yards and not to hurt the feelings of Minority communities by damaging the religious structure of Waqf institution.

It has been noticed that the GHMC wing is issuing frequent notices to the Mutawallis on graveyards and waqf properties.

The Modus-operandi adopted by GHMC is volatile in nature which will not only hurt the spiritual sentiments of Muslim community but also disturb the peace in the community.

Wakf: Demolishing Graves

This act of demolishing the graves may trigger an uproar in the state and no amount of money can compensate for the emotional and religious upheaval roused.

Further more, it is a cause of concern to the community, a big threat to Muslims, Waqf institutions and its properties making room for direct claim filed by Mutawallis and even self-styled custodians and a recent incident of Ashoor khana in Amberpet also calls for an immediate thorough inquiry.

Drawing the attention of the Chairman of Mohd. Masiullah Khan and Chief Executive Officer (CEO) of Wakf Board, Bandagi Badesha said that it is high time that “we need an effective implementation of Chief Minister promise of CB-CID inquiry in the mismanagement of Wakf institutions property.

He has admitted that the order for an inquiry will be issued immediately at the assembly Session at Hyderabad on October 7, 2021.

KCR insisted that the encroachers will be evicted and land will be saved from the clutches of encroachers as the records are safe in government custody. The government tried but in vain.

It is to inform you that the record room of the Waqf Board has been closed since 2018. It has not been opened since then causing irreparable damage in the smooth administratration of the Waqf Board.

Time and again the Court calls for documents/ records from the Waqf Board in cases relating to encroachments, but embarrassingly the Waqf Board is not able to produce those records as they are inaccessible. The Waqf Board has already lost innumerable cases due to such pathetic reasons.

High Court

He stressed that the action of GHMC needs to be challenged immediately in the High Court by way of Writ Petitions because the claims of GHMC are illegal, arbitrary, ab initio act, contrary to the provisions of Waqf Act 1995 and also to the Constitution of India which governs the rights of Minorities.

He pointed out that Muttawalis are not the competent authority to act upon the subject matter, as they are appointed, governed and controlled by Wakf Board, citing this reason the Mutawalis can approach the High Court by challenging the aforementioned claims of the GHMC.
