Justice Brijesh Kumar’s Decision To Hear Arguments On Fair Share Of Krishna Waters Is A Victory For Telangana: Uttam
Hyderabad, Jan 17 (Maxim News): Minister for Irrigation N. Uttam Kumar Reddy said that Justice Brijesh Kumar‘s decision to hear arguments on Section 3 first regarding the fair share of Krishna waters due to the state is a victory for Telangana. He said that he welcomed the tribunal’s orders.

He expressed hope that the state will get fair shares of Krishna waters in the future with the tribunal’s decision. He stated in this regard on Thursday. The main reason for the formation of the Telangana state was the injustice in the allocation of Krishna and Godavari water shares. But, in the talks held between Andhra Pradesh and Telangana for the first time after the formation of Telangana in 2014. KCR put the interests of the state at stake. Out of the 811 TMC given by Bachawat to the joint AP, KCR agreed to the allocation of 512 TMC to AP and 299 TMC to Telangana. That is not the right decision. The Krishna basin in the state is 68.5 percent, and 555 TMS is due to that extent. KCR has written off the interests of the state. There are many projects in the Krishna basin like Palamuru-Ranga Reddy, Kalvakurthi, Nettempadu, Bhima Lift irrigation, etc. that do not have water allocation from the tribunal. At least, they have failed to submit the comprehensive project reports of these projects to the Central Water Commission and Krishna Board and ensure that water allocation is made. Thus, great injustice has been done to the people of Mahabubnagar, Ranga Reddy and Nalgonda districts.
Telangana is being severely unfairly affected by the allocation of water under Section 89 of the AP Reorganization Act. This section was created to make allocations to two new states without touching the allocations made on a project-by-project basis. Telangana will suffer due to this. The state approached the Supreme Court in 2015 to resolve this dispute. It sought the formation of a new tribunal under Section 3 of the Inter-State River Water Disputes Act, of 1956. However, the then Jal Shakti Minister said in the Apex Council meeting held on October 6, 2020, that if the case in the Supreme Court is withdrawn, then a new tribunal will be considered. KCR announced that the case would be withdrawn within a day. However, a petition to withdraw the case was not filed in the Supreme Court until June 2021. The Supreme Court responded two years after the petition was filed. Finally, in October 2023, the Center issued a TOR handing over the responsibility of Krishna water redistribution to the Brijesh Kumar Tribunal, Justice for Telangana was delayed for a long time only due to KCR’s negligence.

Since the Brijesh Kumar tribunal initially agreed to conduct the hearing under Section 3, both states will get fair shares in the entire Krishna waters. AP has been maliciously delaying the tribunal’s hearing. As part of this, it argued before the tribunal that it should conduct the hearing on Section 89 of the Partition Act. Telangana, however, insisted on a hearing on Section 3. The tribunal ultimately upheld the state’s demand. Although AP approached the Supreme Court regarding Section 3, it did not impose a stay. Moreover, it advised AP to participate in the hearing. The tribunal also stated this in the orders issued on Thursday,’ the minister explained. (Maxim News)
