US Warns EB 1 Green Cards For Indians Could Become Unavailable

Washington, Sept. 3: The United States has warned that EB 1 green cards for Indian applicants could become unavailable within weeks due to high demand.

The warning came in the US State Department’s September Visa Bulletin. It said India’s EB 1 allocation could be exhausted before the fiscal year ends on September 30.

The department said it will continue monitoring demand and make adjustments if necessary.

EB 1 Green Card Backlog Deepens for Indians

EB 1 is the first preference employment based category. It covers priority workers, including people with extraordinary ability, outstanding professors and researchers, and certain multinational executives and managers.

For September, the EB 1 India final action date is October 15, 2022. Applicants generally need a priority date earlier than the listed cutoff for final action.

India’s EB 2 category is also listed as unavailable for September. The category covers professionals with advanced degrees and people with exceptional ability.

The EB 3 India final action date is January 1, 2014. This leaves Indian applicants facing a queue that stretches back more than 12 years.

The filing dates provide somewhat later dates for Indian applicants. The September dates are December 1, 2023 for EB 1, January 15, 2015 for EB 2 and January 15, 2015 for EB 3.

Applicants seeking adjustment of status in the US must check which chart the US Citizenship and Immigration Services has authorised for the month.

India’s unreserved EB 5 investor category is also unavailable for final action in September. However, EB 5 set aside categories for rural, high unemployment and infrastructure projects remain current for all countries.

The US has set the worldwide employment based preference limit at 186,317 for fiscal 2026. Immigration law also generally applies a 7 percent per country limit to family and employment based preference visas.
