Appointment Of Mutawwali Of Dargah Yousufain Kept In Abeyance

Hyderabad, Sept 27 (Maxim News): The Telangana government has issued the orders keeping the appointment of Sufiyan Ali Shah as the Mutawalli of the Dargah Yousufain, a Sufi Shrine in Hyderabad in obeyance.

According to the Secretary to the Minorities Welfare Department, Syed Omer Jaleel said that the government’s decision has come after it was found that the Waqf Board had appointed Shah as the Mutawalli without waiting for the outcome of an inquiry that had been initiated into his application.

In January 2021, Shah had applied for the position of Mutawalli. However, his application was rejected by the Wakf Board in June 2021 on the grounds that he lacked merit.

Shah challenged the Waqf Board’s decision in the Telangana High Court. In June 2023, the High Court directed the Waqf Board to review Shah’s application and issue appropriate orders within three weeks.

In July 2023, the Waqf Board initiated an inquiry into Shah’s application under Sections 70 and 71 of the Waqf Act, 1996. However, without waiting for the inquiry report, the Waqf Board appointed Shah as the Mutawalli in the same proceeding.

The government, in a statement, said that the Waqf Board’s decision to appoint Shah as the Mutawalli without waiting for the inquiry report was “inconsistent with the earlier rejection of the applicant’s merits.” the government said that it had suspended Shah’s appointment as the Mutawalli in exercise of the powers conferred under Section 97 read with Section 66(2) of the Waqf Act, 1996.

The government has also directed the Chief Executive Officer of the Waqf Board to take immediate action in accordance with its directive. (Maxim News)
