Delhi/Hyderabad, Feb 6 (Maxim News): The Supreme Court has made some interesting comments on the issue of women’s pregnancy. Let’s now learn about the court’s comments on the rights of minors in case of unwanted pregnancies and their importance.
The Supreme Court has given a sensational verdict that no woman, especially a minor girl, can be forced to continue an unwanted pregnancy. The top court has allowed the termination of a 30-week pregnancy of a young girl while she was a minor. A two member bench comprising Justice B.V. Nagaratna, while, deliversing the verdict, made it clear that the rights of the minor girl should be given first priority in such sensitive cases. The judges commented that she cannot be forced to become a mother against her will.
In this case, theminor girl became pregnant due to a relationship with a young man. However, the court said that whether the relationship was consensual or not is not important here. The main point to consider is that the girl did not want to have the child. Although legally, a minor’s pregnancy is an unfortunate situation, the court held that forcing her to continue the pregnancy in such circumstances is a violation of her autonomy.
Although the arguments of both sides in this case are strong, the court said that the decision has to be taken keeping in mind the girl’s future and her mental state. The latest verdict clarified that a woman has the right to decide whether to continue her pregnancy or not. No system has forced her to get pregnant. Accepting the request made by the appellant, the court agreed to perform an abortion as per medical rules. The court ordered that treatment be provided at JJ Hospital in Mumbai, following all the necessary protocols for this procedure.
The court has directed the doctors of Mumbai’s JJ Hospital to carry out the abortion procedure with the girl’s written consent. This judgment is of utmost importance in terms of women’s physical rights and freedom. The bench revealed that the decision in the present case has been taken from a humanitarian perspective, taking into account social and personal factors, without endangering the lives of minors.
