Hyderabad, Sept. 24: BJP Legislature Party leader Alleti Maheshwar Reddy described the Supreme Court’s decision in the Danam Nagender case as a “constitutional victory” on Thursday.
Reddy issued the statement after the Supreme Court dismissed Nagender’s challenge to his disqualification as Khairatabad MLA.
A bench headed by Chief Justice Surya Kant found no reason to interfere with the Telangana High Court’s September 18 order.
The High Court had disqualified Nagender under the Tenth Schedule of the Constitution after he contested the 2024 Lok Sabha election from Secunderabad as a Congress candidate while serving as a BRS MLA.
Maheshwar Reddy Says Legal Battle Led to Verdict
Maheshwar Reddy said the Supreme Court ruling vindicated the legal battle pursued by the BJP.
He said the party would continue to challenge what it described as unconstitutional actions through legal and political channels.
Reddy also criticised Chief Minister A Revanth Reddy over defections from the BRS to the Congress.
He said the Chief Minister should ensure that MLAs who changed parties resign from the Assembly and face fresh by-elections.
The Supreme Court’s decision leaves the Telangana High Court’s disqualification order undisturbed. The High Court had also declared the Khairatabad Assembly seat vacant.
The case arose from petitions filed by BJP MLA Alleti Maheshwar Reddy and BRS MLA Padi Kaushik Reddy challenging the Speaker’s handling of disqualification petitions.
The Supreme Court’s ruling concerns Nagender’s disqualification and does not by itself determine the status of other MLAs facing separate defection-related petitions.
