Telangana HC Imposes Rs. 3 Lakh Penalty Over Illegal Building

Hyderabad, July 27: The Telangana High Court has imposed a penalty of ₹3 lakh on a property owner for carrying out unauthorised construction in Hyderabad and directed municipal authorities to consider the owner’s application for regularisation in accordance with the law.

Justice Bollam Vijaysen Reddy passed the order while hearing a petition filed by Aruna Agarwal, a resident of Alkapur Township in Neknampur village under Gandipet.

According to the case, municipal authorities had earlier directed the petitioner to stop construction and remove the unauthorised portions of the building.

The sanctioned building plan permitted the construction of a ground floor and two upper floors. However, the petitioner allegedly constructed two additional floors along with a penthouse without obtaining approval.

The High Court observed that the unauthorised construction created nearly 8,000 to 10,000 square feet of additional built up area.

During the hearing, the petitioner’s counsel submitted that the extra floors were constructed to accommodate a joint family. The petitioner also sought directions to the municipal authorities to consider an application for regularisation.

The court observed that illegal constructions have become a serious concern in Hyderabad.

While imposing a penalty of ₹3 lakh, the High Court directed the municipal authorities to examine the regularisation application in accordance with the applicable rules.
