Telangana HC Warns Officials: Knowingly Permitting Illegal Constructions?

Hyderabad, Dec 12 (Maxim News): The Telangana High Court has warned that if the authorities knowingly grant permission and then demolish illegal structures, they will have to issue orders to pay compensation. It has now issued orders to register criminal cases against such officials, and from now on, orders will have to be issued to confiscate the assets of the officials who permitted the demolition of illegal structures.

Sachin Jaiswal and two others have filed a petition in the High Court challenging the notices issued by the irrigation authorities to remove the structures within the Mangarshi Kunta FTL and Buffer Zone in Narkuda village of Shamshabad mandal in Rangareddy district.

Justice C.V. Bhaskar Reddy took up the matter on Wednesday. The petitioner’s lawyer, while hearing the arguments, said that the Assistant Executive Engineer of the Irrigation Department had pasted notices on the wall on the 4th of this month, stating that the structures within the FTL/buffer zone should be removed within seven days. He said that they are trying to demolish the shack houses built with permits. He asked them to issue orders not to interfere in their construction.

After hearing the arguments, the judge questioned how they could demolish the houses built with the permits given by the authorities. He questioned why the irrigation, municipal, and panchayat officials do not give permits as per GO 168. He said that it is true that the Supreme Court and other higher courts have issued orders to demolish the illegal structures and take up the conservation of the ponds. He said that the rules should not be violated. He said that when illegal construction is found, appropriate notices should be issued and action should be taken after obtaining an explanation. The petitioners were ordered to respond to the notices issued by the irrigation authorities with all evidence and documents within 15 days.

In the meantime, the hearing on the petition was closed, instructing the authorities not to take any action on the notices.  (Maxim News)
