Hyderabad, July 7: The Delhi High Court on Tuesday granted interim relief to BRS MLC Kalvakuntla Kavitha in the dispute over the proposed TRS party name. The court directed the Election Commission of India to hear her in person before taking a final decision.
The case relates to the Election Commission’s notices issued on May 12 and June 23, stating that the TRS party name could not be allotted. Kavitha challenged the notices before the Delhi High Court after not responding to them earlier.
The court directed the Election Commission to give Kavitha an opportunity to present her case within one week. It also asked the poll body to take a final decision only after hearing her arguments.
During the hearing, the Election Commission’s counsel submitted that two political parties with similar names had already been registered. Therefore, allotting the same name to Kavitha would violate election rules.
The counsel also informed the court that the Commission had received more than 1,000 objections to the proposed TRS party name. He argued that the Commission had already conveyed its position to Kavitha and that personal hearings were not usually granted in such matters.
However, Kavitha’s counsel argued that the Commission should not reject the application without first giving her an opportunity to explain her case.
After hearing both sides, the Delhi High Court directed the Election Commission to hear Kavitha personally within a week and then pass a reasoned final order.
