Hyderabad, Aug 17 (Maxim News) : The Telangana High Court has raised key questions over the conduct of MLAs who switched parties after winning elections on BRS tickets.
The court asked where the defected MLAs stood when the Assembly considered bills. It also questioned how they voted when party whips were issued.
The bench heard a petition filed by the Bharat Rashtra Samithi seeking disqualification of MLAs who allegedly switched parties.
The petitioner argued that Danam Nagender won the election as a BRS MLA. He later contested the Lok Sabha election on a Congress ticket.
The petitioner also told the court that it had submitted relevant material regarding Nagender’s alleged defection. However, the Speaker’s tribunal had not taken action, the petitioner claimed.
Court seeks clarity on conduct of defected MLAs
The court then questioned the petitioner about the action taken by BRS against the MLAs who changed parties.
The bench also asked where the MLAs stood when the party issued whips. It further sought details about their voting during Assembly proceedings.
The court specifically asked how the MLAs voted when bills came before the House. It also questioned their position during voice votes.
In response, the petitioner said the MLAs continued to claim that they remained BRS legislators. However, the petitioner said they were not participating in BRS party programmes.
The court’s questions focused on the conduct of the MLAs after their alleged switch. The proceedings also brought attention to their voting records and participation in party activities.
The BRS petition seeks action against MLAs who allegedly violated provisions related to party defections. The case could have implications for the continuing political dispute over defections in Telangana.
