Waqf Board | Hyderabad, August 16: The Telangana State Waqf Board is grappling with uncertainty following the repatriation of its Chief Executive Officer (CEO), Mohammed Asadullah, to his parent department.

The sudden move has sparked debate over the next appointment, with legal experts warning against any decision that could violate ongoing court directives and recent legal provisions.

According to sources, Waqf Board Chairman Syed Azmathullah Hussaini has reportedly recommended two names from within the board’s employees for the CEO post.

However, a senior legal expert has cautioned that such an action may amount to contempt of court, as the High Court’s interim order in a writ petition had earlier removed Asadullah from the position.

Waqf Board: Legal Hurdles Under New Waqf Rules

Adding to the complexity, the Waqf Rules 2022, which were framed under the unamended law, had earlier allowed for such internal appointments.

However, under the Waqf (Amendment) Act 2025, the Central Government has withdrawn the rule-making power from State Governments. The new rules, already framed by the Centre under Section 108(A) of the Umeed Act, have come into force.

As per these revised rules, there is no provision for appointing Waqf Board employees as CEO. Any such move by the state authorities would violate the amended law and could invite contempt of court proceedings.

Amid these legal constraints, sources indicate that the Telangana government is considering IAS officer Sk. Yasmeen Basha for the role of Waqf Board CEO.

Currently, she holds multiple key positions, including Director of Horticulture & Sericulture and Full Additional Charge (FAC) Managing Director of Telangana State Seeds Development Corporation.

Significantly, Sk. Yasmeen Basha, a Telangana State Civil Services (TSPSC) officer, was promoted to the Indian Administrative Service (IAS) by the Government of India under Regulation 5(1) in consultation with the State Government for the 2018 Select List.

High Court Hearing on August 18

Meanwhile, the legal battle involving Asadullah’s repatriation is still ongoing in the Telangana High Court, with the next hearing scheduled for August 18, 2025.

The court’s decision could play a crucial role in determining who will take over as the next CEO of the Waqf Board.

As the situation unfolds, all eyes are on the government’s next move. Will it appoint an IAS officer in line with the new rules, or risk legal consequences by promoting an internal candidate?
