Waqf Board Chairman and Member Appointments Challenged in High Court
Waqf Board: Hyderabad, Sept. 18: A writ petition has been filed challenging the appointment of Syed Asmatullah Hussaini as Chairman of the Telangana State Waqf Board and the nomination of M.A.K. Muqeed as an additional member.
The petition argues that the appointments are arbitrary, unlawful, and in violation of statutory provisions under the Waqf Act, 1995, and its amendments.
Petition Seeks Removal of Chairman and Member:
The petitioner sought a writ of mandamus declaring the actions of the State of Telangana, represented by its Principal Secretary of Minorities Welfare Department, as ultra vires.
The petition specifically contests the government’s decision to nominate Syed Asmatullah Hussaini under a “nonexistent category of Eminent Muslim” and appoint him as Chairman of the Waqf Board.
It further challenges the nomination of M. A. K. Muqeed as an eleventh member of the Board, claiming that this move directly violates Sections 14, 14(1)(c), and 14(4) of the Waqf Act, 1995, as amended by subsequent legislations, including the Waqf Amendment Act of 2013.
The plea urged the court to direct the State government to immediately remove both names from the current Board and restore its composition in line with statutory provisions.
Waqf Board | Acts and Decisions of Current Board Called into Question
In addition to questioning the appointments, the petitioner asked the court to declare that all acts, decisions, resolutions, transfers, and alienations made by the present Board in its current constitution are void and lack legal sanctity. The petition also sought an interim order restraining the Board from exercising management powers until statutory compliance is ensured.
The case brings renewed attention to governance and compliance issues within the Telangana State Waqf Board, which has often faced allegations of irregularities in appointments and management of endowed properties. The High Court is expected to hear the matter in the coming days.
The High Court is yet to pronounce its final verdict on CEO Asadullah’s appeal, and the judgment is likely to be issued shortly.
