Supreme Court Stays Yogi Govt’s Order To Shift Students From Madrasas To Govt Schools

The Supreme Court on Monday upheld the Uttar Pradesh government’s order that all students enrolled in unrecognized Madrasas and non-Muslim students studying in government-aided Madrasas be shifted to government schools.

The apex stayed the recommendations of the National Commission for Protection of Child Rights (NCPCR) to stop state funding to Madrasas and Madrasa boards for not complying with the Right to Education Act.

It was hearing a plea by Jamiat Ulama in Hind, which challenged the UP government’s order based on the recommendations of NCPCR.

Earlier, NCPCR had made critical observations on the madrasa education system in its submissions before the Supreme Court, saying that these institutions violate children’s fundamental right to education and are operating in breach of the constitutional mandates and the Right to Education (RTE) Act.
