Hyderabad, Feb 7 (Maxim News): The Telangana High Court has ruled that the government and its officials have no power to block the registration of private properties by placing them on the prohibited list unless they fall under specific legal categories.
The court stated that any action taken against Section 22A of the Registration Act is illegal and invalid.
Why the Case Was Filed
The ruling came after S. Venkatasubbaiah from Bachupally filed a case in the High Court. He challenged the suspension of slot booking on the Dharani portal for selling 1.26 acres of land in Bachupally, Medchal-Malkajgiri district.
Justice C.V. Bhaskar Reddy heard the case. The petitioner’s lawyer, Katika Ravinder Reddy, argued that:
- The land was legally purchased and regularized in 1992.
- The petitioner had received government incentives for the land.
- He paid Rs. 30.35 lakh in registration fees and other charges to sell the land.
- But when he tried to book a registration slot, it was blocked.
The Chief Commissioner of Land Administration (CCLA) had issued an order stopping the registration based on a petition filed by Zulfiqar Ali Khan. However, the petitioner was not given any notice, which violated natural justice and the Registration Act.
What the Court Decided
After listening to both sides, the High Court ruled that:
- The government and officials cannot stop private property registrations unless the land falls under the categories listed in Section 22A.
- A previous High Court ruling in the Vinjamuri Rajagopalachari vs. Principal Secretary of Revenue Department case had already set this rule.
- Only the registration authorities have the right to reject registrations under specific legal conditions.
- Any action taken beyond these rules is illegal.
Final Court Order
The court ordered the government to review the petitioner’s documents and complete the registration within four weeks. With this decision, the case was closed. (Maxim News)
