Hyderabad, March 19: The Supreme Court has expressed displeasure over the obstruction of Enforcement Directorate searches. The Supreme Court ED Searches issue came up during a hearing related to alleged interference in an investigation in Kolkata.

A bench of Justices Prashant Kumar Mishra and N.V. Anjaria observed that it was not a welcome development. The court found that West Bengal Chief Minister Mamata Banerjee obstructed and disrupted ED searches conducted at the AIPAC office on January 8. The remarks were made while hearing a petition filed by the ED.

The bench raised serious concerns about the implications of such actions. It questioned what would happen if other Chief Ministers acted in a similar manner. The court asked whether the ED should remain without any constitutional remedy if its duties are obstructed. Therefore, it stressed the importance of allowing agencies to perform their functions without interference.

ED alleges abuse of power during Kolkata searches

The Enforcement Directorate stated that the obstruction amounted to an abuse of power. It alleged that Mamata Banerjee interfered with searches conducted at the residence of AIPAC chief Prateek Jain. According to the ED, items including a laptop, phone, and several documents were taken away during the incident.

Meanwhile, the ED has sought registration of cases against the Chief Minister and state officials. It argued that such actions hinder the investigation process. The agency emphasized the need for accountability in ensuring that probes are conducted smoothly.

On the other hand, Mamata Banerjee’s counsel Shyam Diwan presented a different view. He argued that allowing a central government department to file a petition against a state government poses a threat to the federal structure of the country. This argument highlighted the ongoing debate over the balance of power between the Centre and states.

The Supreme Court ED Searches matter is set to continue. The bench has scheduled the next hearing for the 24th of this month. Meanwhile, the issue has drawn attention to the legal and constitutional aspects of investigative authority and state intervention.
