New Delhi, June 2: The Central government has amended the Immigration and Foreigners Rules, 2025, introducing stricter regulations for foreign nationals seeking to stay in India beyond the permitted duration of their visas. The revised rules, notified by the Union Home Ministry, change the timeline for mandatory registration and tighten conditions for extended stays.
Under the amended provisions, foreigners entering India on visas valid for 180 days or less must now register with the authorities before the expiry of the 180-day period if they intend to remain in the country beyond the visa validity.
The new notification replaces the earlier provision that allowed registration within 14 days after the completion of 180 days from the date of arrival in India.
Revised Registration Timeline for Foreigners
The amendment also applies to foreign nationals holding visas valid for more than 180 days but carrying a condition that each stay should not exceed 180 days. Such visitors must now complete the registration process before the expiry of the 180-day period if they wish to continue their stay in India.
The government clarified that permission for extended stays beyond the prescribed period will be granted only under emergent circumstances. Officials said the move aims to strengthen monitoring mechanisms and improve compliance with immigration regulations.
Changes for Foreign Children Born in India
The revised rules provide relief in cases involving children born in India to foreign parents.
Earlier, parents were required to inform the registration officer electronically within 30 days of the child’s birth to obtain visa-related services, including a new visa or exit permit.
Under the new provisions, this requirement will not apply if either parent is an Indian citizen and chooses to retain Indian citizenship for the child.
However, if the child subsequently acquires the citizenship of a foreign country while residing in India, either parent must notify the registration officer within 30 days of the change in nationality.
Reporting Requirements for Institutions
The Home Ministry has also revised reporting and administrative procedures for hospitals, nursing homes, and other institutions that provide medical care, accommodation, or lodging facilities to foreign nationals.
Authorities stated that the amendments are intended to streamline immigration administration, improve record maintenance, and ensure better monitoring of foreign visitors staying in India.
The changes come as part of the government’s broader efforts to strengthen immigration management and enhance compliance under the Immigration and Foreigners Rules, 2025.
