Hyderabad, Sept. 18: The Food Safety and Standards Authority of India (FSSAI) has initiated legal action against Nestle India over three infant nutrition products.
FSSAI said the action followed findings of alleged non compliance with food safety regulations.
The regulator examined NAN Excella Pro Stage 1, Lactogen Pro 1 and a follow up formula.
It also reviewed promotional material for the products available on e commerce platforms.
FSSAI Flags Claims in Nestle Infant Products
FSSAI flagged claims related to “5HMOs” and “Whey Protein” in NAN Excella Pro Stage 1.
In Lactogen Pro 1, the regulator flagged a claim describing Whey Protein as easy to digest.
FSSAI said it sought clarifications from Nestle India regarding the claims.
The regulator said both products contravened Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020.
The regulation restricts promotional claims and material intended to increase the saleability of infant foods.
FSSAI also cited Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods Act, 1992.
The provision restricts the advertisement and promotion of specified infant food products.
Separately, laboratory testing found a follow up formula manufactured by Nestle India to be sub standard for biotin content.
The sample underwent re analysis at a referral laboratory.
The referral laboratory also found the sample non conforming with the biotin requirement under the 2020 regulations.
FSSAI said it has filed three separate adjudication cases against Nestle India concerning the three products.
Meanwhile, Nestle India shares were trading nearly 2 percent lower at Rs 1,345.45 on the BSE at 1:10 pm on Friday.
