Delhi/Hyderabad, April 1 (Maxim News): Aam Aadmi Party (AAP) convener and former Delhi Chief Minister Arvind Kejriwal has been booked in a money laundering case related to the Excise Policy. The Enforcement Directorate (ED) has approached the High Court challenging the trial court’s acquittal of Kejriwal after he failed to appear for the hearing despite being summoned by the ED in the case. The high court, which took up the hearing on the ED’s petition today, issued notices to Kejriwal.
A single-judge bench headed by Justice Swarna Kanta Sharma heard the ED’s petition. Advocate Zoheb Hussain argued for the ED. He pointed out to the bench that Kejriwal had not appeared on his behalf despite being served notices in advance. He argued that the trial court had committed a serious error by acquitting Kejriwal. He said that there was clear evidence that he had received summons issued under the Prevention of Money Laundering Act (PMLA).
After hearing the arguments, the bench directed Kejriwal to issue fresh notices and posted the next hearing for April 29. It also ordered the trial court to submit the records. The ED had earlier filed a complaint in the Rouse Avenue Court alleging that Kejriwal had deliberately violated five summons issued by the ED under Section 50 of the PMLA. However, Additional Chief Judicial Magistrate Paras Dalal, who heard these complaints, acquitted Kejriwal, stating that there was insufficient evidence to continue the investigation. The ED has now challenged this verdict in the High Court.
Similarly, a petition filed by the CBI challenging the acquittal of Kejriwal and Manish Sisodia, along with 23 others, in the Delhi excise policy corruption case is also pending in the High Court. Kejriwal has moved the Supreme Court seeking transfer of the case from the bench of Justice Swarna Kanta Sharma to another bench. He has stated in his petition that he has reasonable doubts about the impartiality of the investigation. (Maxim News)
