Vijaya Reddy | Hyderabad, Oct. 1 (Maxim News): Congress leader P Vijaya Reddy has approached the Telangana High Court seeking a stay on the process for the proposed Khairatabad Assembly by-election until the court decides her earlier election petition against former MLA Danam Nagender.
Vijaya Reddy, daughter of late Congress leader P Janardhan Reddy, has sought directions preventing the issuance of the by-election notification until a final judgment is delivered in her 2024 election petition.
She has named the Election Commission and Danam Nagender as respondents in the latest petition.
Vijaya Reddy’s Earlier Election Petition Against Danam Nagender
Vijaya Reddy contested the 2023 Telangana Assembly election from Khairatabad as a Congress candidate, while Danam Nagender contested on a BRS ticket. Nagender won the election by 22,010 votes.
Vijaya Reddy subsequently filed an election petition in the High Court challenging Nagender’s election. She alleged that he had failed to disclose material information concerning the assets of his wife and dependents in his election affidavit.
She sought a declaration that Nagender’s election was invalid and requested that it be set aside. The election petition remains pending before the High Court. The court had earlier issued notice to Nagender in response to the petition.
Khairatabad By-Election: Vijaya Reddy Moves Telangana HC
The latest move comes after Nagender’s disqualification as Khairatabad MLA under the anti-defection law. The Telangana High Court set aside the Assembly Speaker’s decision and disqualified Nagender with effect from April 23, 2024. The Supreme Court later upheld the High Court’s decision.
Following the court rulings, the Telangana Assembly Secretariat issued a Gazette notification declaring the Khairatabad Assembly seat vacant with effect from April 23, 2024. The notification cited the High Court judgment and the provisions of the Tenth Schedule.
The vacancy has paved the way for a by-election. However, the Election Commission has yet to announce the election schedule.
Vijaya Reddy’s latest petition now seeks to keep the election process on hold until her pending election petition is finally decided. The High Court’s response to the request will determine whether the proposed by-election process is affected. (Maxim News)
